These Terms of Service (“Terms”) govern your use of the Project Cleris website and its associated services (“the Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

Eligibility:

Users under the age of 13 must obtain the approval of a parent or legal guardian before creating an account on Project Cleris. By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms.

User Conduct:

You agree to use any given program/service responsibly, respecting the rights of others and complying with all applicable laws and regulations. Any inappropriate behavior, harassment, violence, or harmful actions towards others will not be tolerated and may result in immediate termination of your account and access to the Service. You understand that you are solely responsible for your actions while using the program/service, and Project Cleris reserves the right to take appropriate legal action if necessary.

Account Security:

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Project Cleris immediately of any unauthorized use or suspected breach of security. Project Cleris shall not be liable for any loss or damage arising from your failure to comply with this section.

Intellectual Property:

The Service and all associated content, including but not limited to text, graphics, logos, images, software, and audiovisual materials, are the property of Project Cleris or its licensors and are protected by intellectual property laws. You may not use, reproduce, modify, distribute, or publicly display any of the copyrighted materials without prior written consent from Project Cleris.

Disclaimers and Limitation of Liability:

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. Project Cleris does not guarantee the accuracy, completeness, or reliability of any content or materials available on the Service. You acknowledge that your use of the Service is at your own risk. In no event shall Project Cleris be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Service.

These terms and conditions, along with any other written Program policies and rules (such as the cancellation policy), encompass the entire agreement between you and ProjectCleris.org, and supersede all previous understandings and agreements between us, whether oral or written. If any part of these terms and conditions is found to be invalid or unenforceable by applicable law, then that provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these terms and conditions will continue in effect. Even if we are delayed in exercising our rights or fail to exercise a right in one case, it doesn’t mean we waive our rights under these terms and conditions, and we may decide to enforce them in the future. If we decide to waive any of our rights in a particular instance, it doesn’t mean we waive our rights generally or in the future.

Program Rules:

Project Cleris reserves the right to cancel and/or modify the schedule, location, instructional format, or timing of any of its programs at any time without incurring any liability. Project Cleris may also substitute any camp counselor, teacher, or volunteer for any program as deemed necessary. In the event that Project Cleris is compelled to cancel a Program due to circumstances beyond its control (including, but not limited to, government orders or actions, natural disasters, pandemics, acts of war, civil unrest, or unavailability of transportation or suitable venues for the Programs), no portion of the enrollment fees, membership fees, or other donations paid by you will be refunded.

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of New York. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in New York. The prevailing party in any action shall be entitled to recover all related costs and reasonable attorneys’ fees.

Changes to the Terms:

Project Cleris reserves the right to modify or update these Terms at any time without prior notice. You are responsible for regularly reviewing the Terms. Continued use of the Service after any modifications or updates constitutes your acceptance of the revised Terms.
